We accept no responsibility for web sites or other information, practices or products of other parties linked to the Site. Your dealings with persons found via the Site are between you and such persons and we will not be liable for any loss or damage arising out of such dealings.
3 .CUSTOMER COMPLAINTS
We endeavour to respond to all complaints within five working days. Any customers wishing to complain about any of our services may do so contacting us via the details shown on the contact us page.

4 . DISCLAIMERS
4.1 Prior to entering into a contract with you we reserve the right to change, modify, remove or substitute without notice any information shown on the Site. Any prices shown are subject to change without notice.
4.2 We exclude liability to you for any unforeseeable loss or damage which you may suffer as a result of our negligent performance of any services provided to you except in relation to death and personal injury. THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS IN RELATION TO THE GOODS.
4.3 You acknowledge that all measurements are approximate and that the reproduction of colours is as accurate as the photographic and production process will allow.

5.1 By submitting an order you agree to the processing by us of your personal information and the disclosure of that information as set out in this Clause 4.
5.2 We may use any personal information provided to us by you or obtained by us from any third party relating to you for any purposes relating to the provision of our goods and services.

5.7 The disclosures which we may make under Clauses above may involve the transfer of personal data relating to you to countries outside the European Economic Area which countries may not have in place rules relating to data protection and privacy of personal data which are equivalent to those in the United Kingdom.
6 . INTELLECTUAL PROPERTY
6.1 All rights in the Site design, text, graphics and other content, and the selection and arrangements thereof belong to, or are licensed to us.
6.2 You are allowed to copy or print hard copy portions of the Site for the sole purpose of placing orders with us or our partners. Any other use of materials on the Site, including reproduction for purposes other than those stated above, is strictly prohibited.
7. THIRD PARTY RIGHTS
The statutory right of any person other than you or us to enforce any of these provisions is excluded.
8. SEVERANCE
If any term shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law that term shall to that extent be deemed not to form part of these terms and the enforceability of the remainder of the terms shall not be affected. Except that if the contract is unworkable without such terms then the contract shall be void and unenforceable.
9. HEADINGS
Headings are for reference purposes only and shall not be incorporated into the terms and shall not be deemed to be any indication of the meaning of the clauses to which they relate.
10. WAIVER
No failure on our part to exercise any right or remedy under these terms shall operate as a waiver of that right or remedy and no waiver by us of any breach of these terms by you shall operate as a waiver of any subsequent breach.
11. ASSIGNMENT
You may not assign or transfer or attempt to assign or transfer any of you rights and obligations under these terms without our consent.
12. FORCE MAJEURE
We will not be responsible for any failure to deliver goods to you or for any delay to goods which is caused by events or circumstances beyond our reasonable control or that of our suppliers, which shall include without limitation, industrial disputes, act of God, war, civil commotion, malicious damage, compliance with any law or governmental order or rule, regulation or direction.
13. GOVERNING LAW
These terms and conditions shall be governed by and construed in accordance with English law and any disputes shall be referred to the non-exclusive jurisdiction of the English Courts.
Terms and Conditions of Sale
The following terms and conditions of sale apply to all purchases made by you, the customer, from New Image TV Ltd. In purchasing products from us, you agree to abide by these terms and conditions of sale.
1. Customer Service
We are highly committed to total customer care and abide by the principles of The Consumer Protection (Distance Selling) Regulations 2000. 2. Money Back Guarantee
New Image TV offers a 30-day money back guarantee if you should change your mind. This is calculated from the day that you receive your order. The following conditions will apply:
i. If the item is damaged or lost after being in your care, your right to a money back guarantee is waived.
ii. The item is to be returned at your own expense, undamaged and in it’s original packaging within 30 days of having received it. Original postage and packaging charges will not be refunded.
iii. The money back guarantee policy does not apply if the seal or plastic wrapping on the vitamins or shakes is broken
iv. The money back guarantee policy does not apply to ‘hygiene’ products that have been opened or used. Hygiene products include underwear*, personal beauty products and creams.
v. Please note all returns must be received within the specified money back guarantee period. Any items not received after 30 days will not be refunded and the items will be returned back to you.

3. Returns
For defective or incorrectly delivered items, please contact Customer Services on 0844 800 0631 as soon as the problem is detected, or at least within 30 days of having received your delivery.
When an item is returned to us, we will check it as per the above. If these conditions have been met, the item will be replaced or a refund will be made for the purchase price, excluding postage and packaging charges.
When returning a product please use the original shipping box and packaging materials ensuring that your product is wrapped securely. Make sure you include your name and address and the order number so we can identify the parcel on receipt.

It is advisable that you return your product via registered or recorded postal service as we cannot accept any responsibility for items that are lost in transit.
Your refund will only be credited to the credit/debit card that you used when making the purchase. If this is not possible refunds will be made by cheque. Please allow 7 working days for refunds to be processed.
Please note that refunds for returning products bought as gifts can only be given to the purchaser.
4. WAYS TO PAY
New Image TV accepts VISA, MASTERCARD, SOLO, and MAESTRO CARDS. Please ensure you have a valid debit/credit card when ordering. You will be asked your personal details and it is your responsibility to ensure they are correct. Please note that any refund will only be processed to the original card used for payment. We do not accept cheques.
5. STATUTORY RIGHTS
To obtain a refund you are obliged to return goods in the condition they were received. Please note that any refunds will only be processes to the original card used for payment. However, for the avoidance of doubt, this does not apply to products that are deemed not to have met the required standard, under law. In these cases, such products will be considered defective and the purchase price plus postage and handling costs will be refunded in full.
6. LIABILITY
If you have notified us of a problem with a product we will remedy the problem either by way or replacement or refund. This does not affect your statutory rights.
7. DELIVERY
We aim to deliver our orders within 14 days of them being accepted. Products that are despatched by our nominated carrier will require a valid signature as proof or delivery. Delivery dates are not guaranteed, and do not include weekend or bank holidays. Express delivery means 3-4 working days, again this does not include Saturday, Sunday or bank holidays.
8. AVAILABILITY
All orders are subject to availability. If goes are out of stock, you may be offered a substitute product.
9. VAT
All prices stated include VAT at the appropriate rate.
10. SAFETY ADVICE
For your own safety, we recommend you carefully read all safety/instructional information provided with the product. Please view instructional videos/DVD where supplied. Please inspect electrical products for any signs of damage and notify the Customer Service team if necessary.
11. ERRORS
Every effort has been made to ensure that the information is correct at the time of printing.

New Image TV Ltd is registered as a data under the above Act. Information supplied by you will be used for administering your account details, and for promoting goods and services to you.
